GENERAL PROVISIONS

These Terms of Service („Terms”) govern the provision of services through this website and regulate the conditions of sale of digital products (e-books) offered through the website, in accordance with applicable laws of the Republic of Poland and, where applicable, the laws of the United States.

The website („Service”) offers digital products for sale. In matters not regulated by these Terms, the applicable laws of the Republic of Poland will apply. By using the Service or purchasing products, customers agree to be bound by these Terms.


  1. Liability: The Seller is responsible for ensuring that the digital products provided conform to the terms agreed upon at the time of sale. This liability is regulated under applicable consumer protection laws, including but not limited to the Federal Trade Commission (FTC) Act in the U.S. and relevant Polish consumer protection laws.
  2. Complaints: Any complaints regarding the operation of the Service should be directed to the following email address: contact@exploregalaxy.space. The Seller will make reasonable efforts to respond to all complaints within 14 days of receiving them.
  3. Product Conformity: The Seller is responsible for ensuring the conformity of the digital products sold. If the product is found to be defective or not as described at the time of sale, the Buyer has the right to request a remedy under applicable consumer laws.
  4. Right to Replacement: Under applicable laws, including but not limited to the Magnuson-Moss Warranty Act in the U.S., the Buyer may request the replacement of a digital product if it is found to be defective or non-conforming.
  5. Refunds and Returns:
    • Due to the nature of digital products (such as e-books), all sales are final once the product has been downloaded. Buyers acknowledge and agree that, by completing the purchase and accessing the content, they waive any rights to cancel the transaction or request a refund, except in cases where the product is defective.
    • Buyers are required to explicitly acknowledge this policy before completing the purchase. This acknowledgment is required by checking the following statement:
      „I understand that by purchasing and downloading this digital product, I lose the right to request a refund or return.”
  6. Dispute Resolution: In the event of a dispute arising out of or related to the purchase of digital products (e-books) from the Seller, the parties agree to first attempt to resolve the dispute amicably through direct communication. If a resolution cannot be reached through negotiation, the dispute will be governed by the applicable laws of the Republic of Poland. Any legal action must be brought in accordance with Polish law, and the parties consent to the exclusive jurisdiction of the courts of Poland.
  7. Access to Terms: Customers can access these Terms at any time via a link provided in the footer of the website.

DEFINITIONS

  • Consumer: An individual purchasing products or services through the Service.
  • Terms: These Terms of Service.
  • Service: The online store available at the address: exploregalaxy.space
  • Buyer: Any entity purchasing from the Store.
  • Store: The “exploregalaxy.space” online store operated by the Seller at the address exploregalaxy.space.
  • Seller: Kacper Werakso, ul. Błażeja 4E/34, 61-608 Poznań.
  • Payment Method: The form of payment for the ordered product selected by the Buyer during the order process, offered by the Service through Stripe.


TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, the following are required:
    • A device with Internet access.
    • A web browser that supports cookies and is updated to the latest version to ensure optimal performance.
  2. To place an order in the Store, the following is necessary:
    • An active email account.
  3. The Seller operates the Store from Poland. Customers from the United States should ensure that their internet connections and devices are secure to protect their personal information during the purchase process.

SHOPPING IN THE STORE

  1. The prices of products displayed in the Store are total prices for each product.
  2. The Buyer selects a payment method from those available through Stripe and provides the necessary information to complete the order.
  3. The order is considered placed at the moment of purchase through Stripe.
  4. Placing an order constitutes a contract between the Buyer and the Seller.
  5. The Buyer may make purchases without registering an account.

PAYMENTS

  1. The Service offers the following payment method:
    • Online payment via the Stripe service.
  2. The Buyer places an order based on the prices in effect at the time the order is placed. The Service reserves the right to change prices. This provision does not apply to orders that have already been processed.


PURCHASE

  1. The entire order process is completed immediately upon purchase.
    • The Buyer will be redirected to a page where they can download the digital product.

RIGHT OF WITHDRAWAL

  1. The Buyer acknowledges that, due to the nature of digital products (such as e-books), the right of withdrawal from the contract with the Seller through the Service is limited. All sales are final once the digital product has been downloaded.
  2. However, if the Buyer has not yet downloaded the digital product, they may withdraw from the contract within 14 days without providing any reason.
  3. The withdrawal period expires 14 days from the day the Buyer has entered into possession of the digital product, which occurs upon downloading.
  4. To exercise the right of withdrawal, the Buyer must inform the Seller via email at kontakt@smartero.pl.
  5. In the event of a withdrawal from the contract before the product is downloaded, the Seller will refund all payments received from the Buyer, including delivery costs, without undue delay and in any case no later than 14 days from the date of receiving the withdrawal notice.
  6. The refund will be made using the same payment methods as used by the Buyer for the initial transaction, unless the Buyer agrees to another solution.
  7. The refund process will be initiated only after the Seller has confirmed that the digital product has not been downloaded.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  1. The right of withdrawal does not apply if the digital product (e-book) has been downloaded or accessed in any way, as this indicates that the Buyer has utilized the product and waived their right to cancel the transaction.
  2. The right of withdrawal also does not apply if the digital product has been altered or modified by the Buyer in any way that affects its integrity or functionality.

COMPLAINTS

  1. Any complaints regarding the digital products should be submitted via email to exploregalaxy.space. A properly submitted complaint should at least include the following information: the Buyer’s name, email address, and a description of the reason for the complaint. If the information provided requires further clarification, the Seller will inform the Buyer about the need to supplement the complaint.
  2. The Seller will respond to the complaint within 14 days of receipt.
  3. Upon acceptance of the complaint, the Seller will provide instructions on how to proceed.
  4. Please note that due to the nature of digital products, the ability to return or exchange them may be limited, as outlined in the „Right of Withdrawal” section.
  5. If the complaint is not resolved to the Buyer’s satisfaction, the Buyer may seek alternative dispute resolution options, including contacting consumer protection agencies or using online dispute resolution platforms.

Detailed information regarding the processing of personal data by the Seller can be found in the Privacy Policy of the Service, which is accessible on the website. The Privacy Policy outlines how personal data is collected, used, and protected, as well as the rights of the individuals whose data is processed.

DISCLAIMERS

  1. It is prohibited for Buyers to provide any unlawful content.
  2. Upon purchase, the Buyer obtains a non-exclusive, non-transferable license to use the e-book for personal use only. The Buyer is not permitted to distribute, reproduce, or sell the e-book in any form.
  3. The Seller reserves the right to make changes to the content available on the Service, as well as to make adjustments to the pricing of products offered through the Service, in response to changing market rates.
  4. The Seller is not liable for:
    • Any damages caused by Users’ violations of third-party rights in connection with the use of the Service.
    • Damages arising from disruptions in the operation of the Service or its unavailability caused by reasons beyond the Seller’s control or resulting from events that the Seller could not prevent.
    • Any other damages caused by the User’s failure to comply with the provisions of these Terms.
  5. The Seller reserves the right to modify these Terms at any time.
